Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. The “Join the Inner Circle” Sweepstakes (“Sweepstakes”) begins at 12:00:01 am (“Sweepstakes Start Date”), Eastern Daylight Time (“EDT”) on December 1, 2011, and ends at 11:59:59 pm EDT, on January 31, 2012 (“Sweepstakes Period”). The Sweepstakes is sponsored by Obagi Medical Products, Inc., 3760 Kilroy Airport Way, Ste 500, Long Beach, CA 90806 (“Sponsor”), who is solely responsible for all aspects of this Sweepstakes.
Eligibility: Participants must be a legal resident of the 50 United States or District of Columbia who has reached the age of majority in his or her state of residence at the time of entry. By entering this Sweepstakes, participants agree to these Official Rules and to the decisions of the Sponsor, which are final and binding in all respects. This offer is void where prohibited by law and subject to all applicable federal, state, and local laws and regulations. Employees, officers, and directors (including immediate family members and members of the same household) of the Sponsor (“Sweepstakes Entities”), its divisions, parent company, subsidiaries, affiliates, advertising and promotion agencies, Prize suppliers, and any other entities directly associated with this Sweepstakes are not eligible to participate. All federal, state, and local laws and regulations apply. Void where prohibited.
Two Ways to Enter: 1) During the Sweepstakes Period, participants can enter by making an appointment with their participating doctor and obtaining an online “Validation Code” by pulling off a tear sheet found in the doctor’s office. After obtaining the tear sheet, participants must complete the online registration form available at www.obagi.com/ic (“Website”) and enter the Validation Code (“MyObagi”). Each entrant will be required to provide name, date of birth, zip code and e-mail address. Upon submission of the completed registration form, each entrant will receive one (1) valid Sweepstakes entry.
2) To enter the Promotion by text message entry, participants must have a text message capable phone and text the keyword “MyObagi” to the short code, 30416 from their personal mobile device. Each entrant will be required to provide an email address. Standard text messaging rates, terms, and conditions apply and may not be available from all service providers or for all handsets. Check with your service provider for details.
Participants will receive only (1) entry into the Sweepstakes per person per mobile number/email address/Facebook account when they enter during the Sweepstakes Period regardless of their method of entry. All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of an entry. Internet entries must be made by the entrant only at the Website. Entries made by any other individual or any entity, and/or originating at any other website or e-mail address, including, but not limited to, commercial Sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such entries are void. Sweepstakes Entities are not responsible for lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, or misdirected entries. Sponsor reserves the right to disqualify any person or e-mail address that submits more than the maximum allowed entries by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods, or who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, or proper play of this Sweepstakes. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. By participating, you consent for Sponsor to obtain, use, and transfer your name, address, and other personally identifiable information to the Sweepstakes Administrator, its affiliates, agents and marketers for the purpose of administering this Sweepstakes as described in these Official Rules.

Internet Limitations of Liability: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes in whole or in part, at any time, without notice, or to disqualify any individual who tampers or attempts to tamper with the entry process, and thereafter, award the Prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification, or suspension date, or in any manner that is fair and equitable. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be determined as the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor is not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s e-mail account to receive e-mail messages. Sponsor is not responsible, and may disqualify an entrant, if the entrant’s e-mail address does not work or if it is changed without prior written notice to Sponsor.
Prizes: Fifty (50) Prize winners will each receive Obagi product(s) with an Approximate Retail Value (“ARV”) of $100.00 (each a “Prize”). Total Prize Pool is $5,000. All local, state, and federal taxes are the sole responsibility of winner. By accepting the Prize, each Prize winner agrees to release the Sponsor, Sweepstakes Administrator, vendors associated with the Sweepstakes, and the respective officers and employees of these entities (the “Released Parties”) from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any Prize or resulting from acceptance, possession, or use/misuse of Prize awarded. Each Prize will be awarded “as is” with no warranty or guarantee, either express or implied, by Sponsor. Prizes are not exchangeable, transferable or redeemable for cash. No substitution of a Prize will be permitted unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute the Prize with another Prize of equal or greater value in the event that any aforementioned Prize is not available. All decisions by Sweepstakes Administrator as to Prize winners and Prizes are final. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.
Drawing and Notification: All Prize winners will be selected in a random drawing from all eligible entries received on or about February 5, 2012.The Prize drawing will be conducted by the American Sweepstakes & Promotion Co. (“Sweepstakes Administrator”), an independent judging organization. Odds of winning will depend on the total number of eligible entries received.
All potential Prize winners are subject to verification by Sponsor or the Sweepstakes Administrator, whose decisions are final and binding on all matters related to this Sweepstakes.
Prize Conditions: All taxes, if applicable, are the sole responsibility of each Prize winner. If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential winner, if a potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the Prize at issue. The winner’s entry, and acceptance of the Prize, constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice, and address (city and state), in all forms of media, in perpetuity, throughout the world, and without notice, review, approval, or further compensation. Each winner waives any right to inspect or approve any such use.
Terms & Conditions: This Sweepstakes is subject to all applicable federal, state, and local regulations and laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator and Sponsor, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, from and against any claims, damages, or liability due to any injuries, damages, or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use, or misuse of any Prize offered, or participation in this Sweepstakes to the fullest extent permitted by law. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law. This Sweepstakes is void where prohibited. Entrants acknowledge that Sponsor and its agents have not made any representation, warranty, or guaranty, in whole or in part, in law or in fact, relative to the Prize.
Disputes: Except where prohibited, entrants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
